This document sets out the terms and conditions (“terms”) you need to be aware of when using this website or purchasing from us. Please take a moment to read it, as it outlines the terms of our relationship and helps establish clear boundaries and expectations. Together with our Privacy Policy and any other guidelines or rules posted on the website from time to time, these terms form a binding agreement between you and Naturlind Wellness (“we”, “us”, “our”).

These terms apply whenever you visit this website or purchase services and/or products from us. By visiting this website, using our services, or purchasing our products, you agree to comply with and be bound by these terms. If you do not agree, please do not continue to use the website, services, or make purchases from us. 

If you are under the age of 18, a parent or guardian must read and agree to these terms on your behalf. In this case, reference to “you” means you and your parent/guardian, as applicable.

We reserve the right to modify or update these terms at any time by posting the revised version on this website. Your continued use of this website or our services and/or products following any changes constitutes your acceptance of the updated terms. 

All products and services advertised on this website are offered in compliance with the Australian Consumer Law.

There may be additional specific terms of service provided to you in relation to our services. If there is any inconsistency between those specific terms of service and this document, these website terms are overruled to the extent of the inconsistency.

On this website, in our emails, and on our social media accounts you may find information related to nutrition, herbal medicine, and a naturopathic approach to health and wellness. We take care to provide valuable information however we cannot be responsible for the use of that information. Please note generalised health advice we provide is not a substitute for a naturopathic consultation where advice is given specific to your personal situation. Why Work With Us

Nicole holds a Bachelor of Health Science in Naturopathy. She is also a member of the Australian Natural Therapists Association (ANTA) demonstrating that she has met the educational criteria required for professional membership and is committed to delivering safe and effective care. As an ANTA member, she is required to uphold high educational standards and complete annual continuing professional development (CPD) to maintain professional membership.   

Your Responsibilities

Our naturopathic services aim to empower you with the knowledge and tools to improve your health however you are responsible for implementing these strategies. We ask that you:

  • arrive on time for your consultations

  • be courteous and respectful to our practitioners, staff and clinic guests at all times

  • complete any intake and follow up documentation required and provide accurate and complete information about you (or your child if you are a parent/guardian completing information on behalf of your child) and update this information as required. This includes any medical conditions, known allergies or intolerances, medications or supplements you are currently taking and any changes in dosage during the period you receive products and services from us, dietary preferences, alcohol intolerance, if you are pregnant, breastfeeding or trying to conceive, and any other relevant information to know when providing products and services to you

  • comply with any health and safety rules and guidelines required by us from time to time

  • deal with us in good faith

  • comply with all applicable laws and these Terms

We work with clients to make small, incremental and sustainable changes for long term wellness. Naturopathy may not be the right fit for you if you’re looking for a quick fix without potentially changing the habits that are influencing your health including diet and lifestyle factors. You are responsible for your treatment outcomes, completing tests and obtaining your results in a timely manner, staying committed to review consultations, and adhering to the recommendations outlined in your individual treatment plan to the best of your ability.

Our treatment plans and prescriptions are uniquely tailored to you and your health goals so please do not share then with anyone else. Any products prescribed are for you, and you alone. You must not give any of your prescribed products to family members or friends. Please never cease existing medical treatment without consulting your doctor. We encourage all individuals to seek advice from a qualified health professional prior to any self-prescription to ensure safety and efficacy.

We reserve the right to refuse or discontinue services and products to you if you do not comply with these Terms. You agree that if you breach these Terms, or any liabilities are incurred by us arising out of your use of our services and products, you will be responsible for the costs and expenses that we incur as a result of the breach. We are not liable for any information, on our website or elsewhere, being inaccurate, incomplete or not up to date; any breach by you of these Terms, any misuse of our services or products or any breach of other laws by you.

Achieving Expected Results

Naturopathic care is a gradual process, not a quick fix, that requires commitment from you to achieve long term health and the results you want. We are here to support and guide you in your journey towards optimal health however ultimately you are responsible for your own health decisions.

Everyone’s health journey is different and results vary based on your individual health circumstances, environment and other factors. Therefore no guarantee of any specific outcomes or improvements in any condition or symptoms is provided from using our services, products or advice. You agree to take any natural treatments, dietary advice, herbal medicine and nutritional supplements at your own risk. Everyone responds differently to natural medicine, and there is a chance you may not see any benefits or that symptoms may worsen. We are not held responsible should your health condition or symptoms become worse after starting treatment under our care. If your symptoms do worsen, please contact us to discuss.      

Allergic or Adverse Reactions

It is your responsibility to notify us of any allergies, intolerances or reactions you have experienced previously prior to the initial consultation. If you experience an unexpected allergic or adverse reaction to a product we have prescribed, you must discontinue use immediately, seek medical attention where needed, and notify us as soon as possible. If you are experiencing life threatening symptoms (e.g. anaphylaxis) you must call 000 immediately.

Some of our products or dispensed items may contain ingredients derived from potential allergens, ingredients that you may react to (like gluten, dairy, nuts, etc), or ingredients/herbs that are not suitable for certain conditions, including pregnancy. It is your responsibility to carefully read through the ingredients list prior to purchasing any products or dispensed items.

By purchasing our products and/or dispensed items, you acknowledge and agree that we will not be held liable for any allergic or adverse reactions, and that we do not exchange or refund based on such allergic or adverse reactions to products. We are not liable for any outcomes resulting from the use of our products or services. If you experience any irritation, side effects or adverse reactions, you should cease use immediately, seek medical attention where needed, and consult your healthcare provider. 

External Referrals

We are dedicated to enhancing your whole health and wellbeing using naturopathic medicine. However, there are times when the services you need for healing are outside of our scope of practice. In these cases, we will refer you to a suitable practitioner, such as a GP, counsellor, psychologist, chiropractor, physiotherapist, osteopath etc.

SERVICES AND PRODUCTS

Consultations

Naturopaths support the whole person and aim to uncover the root cause of your symptoms.  Our consultations provide personalised health assessment and recommendations based on your individual needs. In these consultations, we will discuss your presenting concerns, health history, and dietary and lifestyle factors. Treatment recommendations may include dietary modifications, lifestyle changes, or practitioner only products.

You can book a consultation via our website or email us at hello@naturlindwellness.com.au. Consultations are available in person and online via Halaxy Telehealth. You are responsible for ensuring you have access to a computer, a phone and reliable internet, to access the benefit from our services.

Testing

Functional or pathology testing may be recommended. You will be advised whether testing will occur onsite at our clinic or off site by third party providers. We are not responsible for the accuracy of any tests. Where you have ordered a test that requires a DNA sample (ie hair sample, saliva, or blood), you authorise us, where required, to collect, handle and process those DNA samples for testing including sending to third party laboratories or organisations for testing. You acknowledge that DNA samples will not be returned to you.

All test results must be discussed in a consultation.

Products

To access and purchase practitioner only products, you will require a consultation prior to purchase. Products will be dispensed following your consultation and receipt of payment. For online consultations, your order will be delivered to the address provided in your intake form.  

We make every effort to ensure all descriptions, information and images of our services and products on this website are accurate, however we cannot guarantee they will meet your expectations. We reserve the right to limit the availability or quantity of any products or services to individuals, locations, or jurisdiction at our discretion.  

All services, product descriptions, and pricing are subject to change or discontinuation at any time without notice, at our sole discretion. Any offer for services or products on our website is void where prohibited. We do not guarantee that any service, products, information or material purchased will meet your expectations or that any errors will be corrected.

All order places are subject to our acceptance and availability. A contract of sale is only formed once we accept your order. We are not responsible for any orders placed with third party suppliers (vital.ly, Ariya, Oborne Health Suppliers etc). If you purchase from third party suppliers, you agree to comply with any terms of those parties and the applicable laws.

We reserve the right to refuse, limit or cancel any order you place with us at our sole discretion.  This may include orders place by or under the same customer account, credit card, billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you using the contact information provided at the time the order was placed. We reserve the right at our sole discretion to limit or prohibit orders that appear to be placed by dealers, resellers or distributors.

If there are any issues with your order (such as shortages, damage or wrong products have been delivered), you must notify us within 7 days of delivery. You can notify us at hello@naturlindwellness.com.au. Please include proof of purchase and full details of the issue, and any relevant documentation reasonably requested by us. If products need to be returned, you will pay the cost of transport and insurance of the products to and from us. If products are purchased from a third party, you should contact the third party directly.

If a product is recalled, you will have a new product issued to you as soon as possible, or you will be refunded for that product. This situation is rare but can happen and we will contact you immediately to cease the consumption of the specific product.

FEES AND PAYMENTS

All prices on the website are listed in Australian dollars and do not include GST. We reserve the right to change our fees at any time with notice provided on this website.

All payments made through this website are processed through Stripe. Consultation payments are processed through Stripe/Square which is linked to Halaxy software. Please look at their websites directly for their current privacy/security policies. We accept payment methods of credit cards or EFTPOS (surcharge applies). Options to pay via bank transfer is available and preferred to avoid fees. Our account details are provided on your invoice. We do not have access to your account details.  

A deposit is due at the time of the booking to secure your appointment. All deposits are non-refundable. Once deposit is received, you will be sent a confirmation email. This deposit is deducted from your final invoice. Full payment for your consultation is required on the day of your appointment, including bank transfers. Any recommended supplements or testing is at an additional cost, and are to be paid for before the consultation ends. If you cancel or reschedule your appointment with at least 3 full business days notice, your deposit will be transferred to the new scheduled appointment time.

Should you receive an invoice for consultations or supplement orders, payment is due within 48 hours from the time and date of receiving the invoice. If payment is not received after 48 hours, you will be sent a reminder. Reminders will be sent every 3 days until full payment is received. After the first reminder, an administrative fee of 5% (inc. GST) of the invoice cost will be added to the total amount due for every reminder sent. If there is a problem with payment, please contact me as soon as possible to make alternative arrangements and avoid incurring this administrative fee. Failure to pay fees will be considered a breach of terms and, in this case, access to services and/or products will be suspended until payment is made. If payment is not received up to 90 days, you agree to pay all costs, including debt collection agency fees, that may incur taking steps to recover any money that you owe to us.

Any dispensed items will only be prepared and shipped after payment has been received. If an item is not in stock, you will be notified, and it will be shipped once available.

We do not offer payment plans at this time.

You agree to provide current, complete and accurate billing and account information for all payments made at our website. If we identify any discrepancies, we reserve the right to suspend or cancel your order, consultations, or packages until accurate information is provided.

All consultation packages are valid for 12 months from the date of purchase and must be paid in full at the time of booking to secure your package. You must utilise all sessions within this timeframe as no refunds are provided. Any consultations that are not used within the 12 month period will be forfeited, and a consultation or consultation package will need to be repurchased at the full price if desired.

APPOINTMENT POLICIES

Online Consultations

All online appointments are delivered via Halaxy Telehealth platform. A link will be emailed to you after booking your appointment. Please click this link at the time of your appointment where we will begin the consultation. Due to the nature of online appointments, please ensure you are in a private and quite space away from any distractions and have a strong Wi-Fi connection. A café or public space is not suitable. To help us assist you to the best of our ability, your full attention is needed, so please reschedule if you are going to be driving or supervising young children.

Cancellation and Rescheduling Policy

We respect your time is valuable and we kindly ask that you respect our time. We require 3 full business days notice (excluding weekends and public holidays) to cancel or reschedule your appointment. Cancellations or reschedules that are received within 3 full business days of the scheduled consultation will incur a fee of 50% of the consultation fee. Cancellations, reschedules or no shows within 1 full business day will incur a fee of 100% of the consultation fee, and your non-refundable deposit will not be transferred towards future appointments. This helps honour the time reserved for you and the preparation we do prior to your appointment, ensuring fairness to other clients who may be waiting for availability. Reminder emails are sent in advance as a courtesy and does not relieve you of your responsibility to attend. Late arrivals will result in reduced treatment time, but the full consultation fee will still apply. Arriving more than 10 minutes later may be considered a no show and the full consultation fee will be charged. You can provide adequate notice via email. These details are listed in your appointment confirmation email.

If for any reason, we cannot attend an appointment due to sickness or unforeseen circumstance, you will be advised as soon as possible. In this instance, we will offer you the option to either reschedule your appointment or receive a full refund of the deposit paid. We are not liable for any loss or damage whatsoever arising from the cancellation.

Failure to Attend Consultation

If you fail to attend a consultation without notice, we will endeavour to contact you via phone call or email at the time of your scheduled appointment. If you fail to attend your appointment 15 minutes after the schedule time, the session will be forfeited and no refund will be given. You will be offered to reschedule your appointment with full payment to be made at time of booking to secure your appointment.

Intake Forms

All new clients are required to complete an intake form. We kindly request you complete the form no later than 3 business days before the scheduled consultation. If the intake form is not received prior to the scheduled appointment, it will need to be completed during your appointment which will result in loss of consultation time. No additional time will not be offered to compensate for lost time. The full consultation fee will still be charged, and further consultations may be required to gather any information missed. Access to the initial consultation intake form can be found in the link in your booking confirmation email.

We will always strive to provide you with the best naturopathic care possible, however, if you do not provide us with accurate information about your health, we may not be able to offer you the most appropriate treatment for you and therefore you may not see the results you desire. You must provide us with full and accurate information about your diagnosed medical conditions, known allergies and intolerances, medications or supplements, any changes in dosage during the period you receive products and services from us, dietary preferences, alcohol intolerance, if you are pregnant, breastfeeding or trying to conceive, and any other relevant information  so we can ensure safety of treatment and check for pharmacological interactions with any herbs or nutrients we prescribe.

Discovery Calls

Discovery calls provide an opportunity for you to learn more about the consultation process, how naturopathy may support your health needs, and to see if we are the right fit for you. We are happy to answer any questions about the consultation and treatment process however please note we are unable to cover any specific health questions or provide any treatment advice during this session. These questions can be covered in depth with the purchase of an Initial Consultation which we will discuss during our Discovery Call together. Clients are entitled to one Discovery Call before booking an Initial Consultation. If you are wanting further information, you will be advised to book in for an Initial Consultation.

COMMUNICATION POLICY

Email Policy

We value clear communication and are committed to providing quality support to our clients. Regarding communication outside of scheduled consultation hours, contact can be made through email only. Text and other messaging platforms will not be monitored or responded to so please avoid sending queries through these channels. We aim to respond to emails within 2 – 3 days, Monday to Friday, during business hours. Please allow additional time for response on weekends or public holidays.

Please keep in mind that we are unable to provide health advice or treatment recommendations via email or other forms of communication outside of consultations. All health-related inquiries, treatment plans, or health concerns will only be addressed during scheduled consultations. You may be advised to either wait until our next appointment or bring your appointment forward if your query is more urgent.

For general inquiries, please email us at hello@naturlindwellness.com.au. For medical emergencies or urgent concerns, please contact appropriate services such as your GP,  a hospital, or call 000. By contacting us outside of your consultation, you acknowledge that we are unable to provide detailed advice or treatment through email or other non-consultation channels.

Respectful Communication

We reserve the right to delete any comments on our website or social media accounts which is rude, offensive or which we deem to be unacceptable. Disrespectful or aggressive behaviour will not be tolerated. Please keep all communication kind and polite.

SHIPPING AND DELIVERY

Shipping Method

All orders will be sent via Australia Post using Parcel Post. No orders will be shipped until full payment for those goods has been received. While we do not typically offer Express Post it may be available upon request at an additional cost. If you require Express Post, please inform us prior to the end of your consultation so we can accommodate your request. International shipping is not available.

Shipping Charges

A flat rate standard shipping fee of $15 applies to all orders up to 5kg. Any orders over 5kg will be charged accordingly based on weight and size of the parcel.

Handling Time

We dispense items (including herbal tonics, teas, creams and flower essences) by order and will endeavour to dispatch all ordered within 2-5 business days of receiving your payment, excluding public holidays and weekends. You will be notified via email or phone in the event your order is delayed.

Delivery Times

Deliver times vary but depending on location. Once shipped, orders should be received within 2-7 business days (check the Australia Post website to estimate delivery times from postcode 6000 to your own postcode).

These timeframes are provided as a guide only and commence from the date of dispatch. We are not responsible for postal or courier delays or circumstances beyond our control.

REFUNDS POLICY

All payments are non-refundable. We do not offer refunds for change of mind for any services, packages or products, so please carefully consider your purchase prior to payment. This also applies to sale items, special orders and dispensed items. These items are tailored specifically to your individual needs and therefore no refunds or returns can be offered for these products.

Refund requests will be handled in accordance with Australian Consumer Law provision. Due to the nature of our services and products, we do not accept returns of exchanges outside of these provisions.

We will only offer a replacement of refund for damaged or faulty products at our discretion, and provided they are unopened and unused. You must notify us of any damage or errors regarding their delivery within 7 days of receipt. We cannot be held responsible for the shipping of returned items, and shipping costs will not be refunded unless an issue or fault with the product is confirmed. Refunds will be processed within 7 business days using the same method as the original payment. Replacements will be processed in line with our standard shipping and handling times. Items must be returned in saleable condition, unopened with all packaging and hygiene seals intact.

We do not accept returns when the product has not been stored or used in an appropriate way, has been altered in any way, is not in its original condition and packaging, where you have failed to follow any instructions or guidelines provided by us or on the packaging, if the product has continued to be used after any defect becomes apparent or would have become apparent to a reasonably prudent user, or due to any accident or force majeure.

 If you are not satisfied with your order, please contact us via email within 7 days of your purchase and we will do our best to resolve your concerns. If we are unable to reach a resolution, a refund or replacement may be issued at our sole discretion based on the situation following the timely return of the purchased products.

Order Fulfilment Policy

If any products become out of stock after you submitted your order, you will be notified via email as soon as possible. An option or a refund or to wait until the product is back in stock will be offered.‍

WARRANTIES, LIABILITIES AND CONSUMER GUARANTEES

Delivery of products to a carrier is deemed to be delivery of the products to you. Risk in the products transfer to you once we deliver the products to the carrier.

We reserve the right to refuse service to anyone for any reason at any time.

Product descriptions are for the sole purpose of identifying products. They do not constitute a warranty.

We make no express warranties or representations other than as set out in these terms and we exclude all liability to you. Nothing in our terms excludes, restricts or modifies any right under Australia Consumer Law. Limitations and exclusions are made only to the extent that we may legally do so.

We warrant that our services will be free from defects in materials and workmanship under normal use, and in the case of products, up to the expiry or best before date indicated on the packaging, if applicable, subject to the limitations and exclusions outlined in these terms.  

We take our obligations under Australian Consumer Law seriously and will do our best to address any issues that arise. Our services and products come with guarantees that cannot be excluded under Australia Consumer Law. However, even if there is a major problem, our liability is strictly limited to:

  • Replacing the goods or providing the services again; or

  • If we are unable to do so in a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

If you feel that there is any problem with the purchase of any of our services, please let us know within 7 days. We are keen to understand what has gone wrong if you are unhappy so that we can address your concerns and try to find a mutually acceptable solution.

We do not make any guarantees or warranties about the accuracy of any material displayed on this website, or the products, services, or programs offered through it, expect for any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. If you see an error, please let us know.

While we make all reasonable efforts to ensure that this website and our services meet with the highest standards of best practice, if something does go wrong, you agree that, to the fullest extent permitted by law, we will not be liable for any loss or damage arising out of or related to our website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseen and regardless of the nature of the claim.

You take full responsibility for your implementation of any suggestions that we may make while providing my services. You understand that our advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or making significant changes. You agree to indemnify us against all consequences arising directly or indirectly from your choices.

You expressly agree that if this limitation of liability is unenforceable for any reason, our total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to us for our services.

We are not liable for any consequential loss suffered by any persons.

Neither Party will be liable for any failure to perform its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control, including epidemics, pandemic, quarantine, biological contamination, entry and exit restrictions, industrial disputes, strikes, lockouts, lockdowns, acts of god, acts or threats of terrorism or war (“Force Majeure”). This applies provided that the failure or delay could not have been prevented by reasonable precautions or workarounds. However, this does not apply if the Force Majeure event is caused by a breach of the Terms by the non-performing Party. If a Force Majeure event occurs, we may suspend or terminate an order or booking by providing written notice to you.

The Terms constitute the entire agreement between the Parties concerning its subject matter and supersedes all prior communications.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, we own all rights, title and interest (including intellectual property rights), in any information provided to you in the delivery of our products and services. Your use of our products and services, and your submission of personal information to us, including your health information, does not grant or transfer to you any rights in our products or services. The use of our trademarks, content and intellectual property is protected by copyright. You may not copy, duplicate, republish, redistribute, create derivative, sell or otherwise exploit any material from our services or website without written permission. Unauthorised use of our business name, logo or content may result in legal action. You understand that certain services and products may contain information deemed as confidential, and you agree not to disclose this information without our written consent, which may be withheld at our sole discretion. This confidentiality limitation does not apply to sharing details of our services, products, recommendations or test results with your primary care physician or other relevant healthcare providers, which we strongly encourage.

DISPUTE RESOLUTION AND JURISDICTION

You agree to communicate with us if you have any concerns, issues or complaints arise out of your use of this website or our products or services, with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. You agree to cooperate with us at your own expense in the handling of disputes, complaints, investigations or litigation including those that arise out of or relates to incorrect information you have given us. This agreement is subject to the governing law of Western Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Western Australia, and the Commonwealth of Australia, will have exclusive jurisdiction.

DEFINITIONS

Definitions In these Terms:

ACL means the Australian Consumer Law Schedule of the Competition and Consumer Act 2010 (Cth).

Associate in relation to a Party, means the employees, officers, directors, contractors, and agents of that Party.

Business Day means a day other than a Saturday, Sunday or a public holiday in the capital city identified in the Schedule.

Consequential Loss means, without limitation, indirect, consequential or remote loss or damage; special, punitive or exemplary damages, loss of profit, revenue, business opportunity, goodwill or reputation and any other special loss or damage.

Consumer has the definition given to it in the ACL.

Corporations Act means the Corporations Act 2001 (Cth).

Fee means the amount payable by you to us for our Products and Services.

Force Majeure has the meaning given in clause 7.1 (Force Majeure).

GST means the Goods and Services Tax as defined under the A New Tax system (Goods and Services Tax) Act 1999 (Cth).

Intellectual Property Rights means all intellectual and industrial property or protected rights, including copyright, moral rights, patents, trade marks, trade names, confidential information, know-how, trade secrets, registered or unregistered designs, database rights and domain names, whether or not any of them is registered and including applications for registration of any such thing now or in the future in force and effect worldwide.

Minimum Notice means a minimum notice required to cancel a consultation booking, as set out in the Schedule.  

Privacy Policy means our privacy policy set out on our Website from time to time.

Products means products made available for purchase by us (whether in our clinic or online) and/or via third party health suppliers such as vital.ly, Oborne Health Supplies, Ariya, Metagenics:

a)      remedies and treatments which may include herbal medicine, practitioner-only supplements, retail supplements, homeopathic preparations, nutraceuticals, teas, and tonics;

b)      skincare, beauty products and cosmetics;

c)      baby and pregnancy related goods;

d)      meal plans;

e)      household products and cleaning products;

f)        food and beverage products;

g)       educational products which may include e-books, books, and online courses and programs;

h)      gift cards.

and other associated health and wellness products made available by us from time to time.

Services means any health and wellness services provided by us from time to time including consultations with a practitioner, functional and other health and wellness testing, provision of personalized treatment plans, oral and written advice and recommendations, formulation and provision of personalized remedies, provision of health and wellness related courses and programs.

Warranty Period has the meaning given in clause 3.5 (Warranty).
